General Terms and Conditions of Sale — AMALFI VIBES

1. Seller

The seller is ELYSIUM S.R.L., owner of the AMALFI VIBES brand, with registered office at Via Maestra dei Villaggi 22, 84011 Amalfi (SA), Italy, VAT number and tax code 06424260658, certified email (PEC) elysiumamalfi@pec.it, email info@amalfinewservice.it. The online shop is available at https://amalfivibes.com/shop.

2. Scope

These terms govern the distance sale of physical goods through the AMALFI VIBES online shop. They do not apply to rentals, excursions or other experiences, which have their own terms.

A consumer is a natural person buying for purposes outside their trade, business, craft or profession (Art. 3 of the Italian Consumer Code, Legislative Decree 206/2005). Nothing in these terms limits the rights that the law grants to consumers on a mandatory basis.

3. Products

The shop offers AMALFI VIBES T-shirts, caps, linen garments, bags, towels and accessories. The main characteristics of each product (materials, composition, sizes, colours, variants, care instructions and any personalisation) are stated on its product page.

Photographs illustrate the product but colours may differ slightly depending on the screen used. The contractual characteristics are those described on the product page and in the order summary.

4. Prices and VAT

Prices are in euro and, for consumers, include VAT and any other applicable taxes. Shipping costs and any other additional charges are shown clearly in the cart and in the order summary before the customer confirms the order. The price applied is the one shown when the order is sent.

5. Ordering process

Online checkout is not yet active: purchases cannot currently be completed on the website. Once enabled, the purchase will follow these steps: choice of product and variant, adding to cart, summary with prices and shipping costs, checking and correcting details, choice of payment method and confirmation.

Before sending the order the customer can check and correct the data entered. The final button is labelled "Order with obligation to pay" or an equivalent wording that clearly indicates the obligation to pay (Art. 51(2) Consumer Code).

6. Conclusion of the contract

Sending the order constitutes an offer to purchase. The contract is concluded when the customer receives the order confirmation from ELYSIUM S.R.L. at the email address provided. The confirmation summarises the products, prices, shipping costs, delivery details and these terms. It is sent on a durable medium (an email containing or attaching these terms), at the latest on delivery (Art. 51(7) Consumer Code).

7. Payment

The planned payment methods are payment cards, PayPal, Apple Pay and bank transfer. Only the methods actually enabled and shown to the customer at checkout when ordering can be used. Card details are processed directly by the payment service provider and are not stored by ELYSIUM S.R.L.

For bank transfers, the bank details and payment deadline are given in the order confirmation; the order is shipped once payment is received. No surcharge is applied for using a particular payment method.

8. Availability

Product availability is shown on the product pages. If, after the order, a product turns out to be unavailable, ELYSIUM S.R.L. informs the customer without delay and, if payment has already been made, refunds the full amount paid for that product within 14 days, using the same payment method. Alternatively, the customer may accept an equivalent product if one is offered.

9. Shipping and delivery

Orders are shipped by standard courier to Italy and to the European Union countries shown as available at checkout. Shipping costs are calculated and shown before the order is confirmed. In-store pickup is not available.

The estimated delivery time is 3–7 business days from dispatch. Dates are estimates and may vary for reasons beyond the control of ELYSIUM S.R.L. Unless otherwise agreed, delivery always takes place within 30 days of the conclusion of the contract (Art. 61 Consumer Code). If delivery does not take place within that period, the customer may set an additional period and, if this is not met either, terminate the contract and obtain a refund.

The risk of loss of or damage to the goods passes to the consumer only when the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of them (Art. 63 Consumer Code). Customers are asked to report visible damage to the packaging to the courier on delivery; failure to do so does not affect their statutory rights.

10. Right of withdrawal

The consumer may withdraw from the contract, without giving any reason and without penalty, within 14 days from the day on which the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of the goods. For multiple goods delivered separately, the period runs from delivery of the last item.

To withdraw, the consumer sends a clear statement before the deadline to info@amalfinewservice.it, to the PEC elysiumamalfi@pec.it or by post to ELYSIUM S.R.L. — AMALFI VIBES, Via Maestra dei Villaggi 22, 84011 Amalfi (SA), Italia. The model form at the end of this page may be used but is not mandatory. ELYSIUM S.R.L. acknowledges receipt without delay.

11. Personalised goods

The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised according to the customer's instructions (Art. 59(c) Consumer Code), for example with a name, text or image chosen by the customer. The product page states when an item is personalised.

Products with standard AMALFI VIBES catalogue designs, including collection prints, are not personalised goods and remain subject to the right of withdrawal. Rights for lack of conformity always apply, including to personalised goods.

12. Returning the goods

The consumer returns the goods without undue delay and in any event within 14 days of notifying the withdrawal, to: ELYSIUM S.R.L. — AMALFI VIBES, Via Maestra dei Villaggi 22, 84011 Amalfi (SA), Italia. The deadline is met if the goods are sent before it expires.

The direct cost of returning the goods after withdrawal is borne by the consumer. This rule does not apply to defective or non-conforming products, or to shipping errors by the seller: in those cases ELYSIUM S.R.L. bears the costs.

The consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning, for example prolonged use or washing.

13. Refunds

In case of withdrawal, ELYSIUM S.R.L. refunds all payments received, including the initial standard delivery costs, without undue delay and in any event within 14 days of being informed of the withdrawal. Additional costs resulting from the customer's express choice of a delivery method more expensive than standard delivery are not refunded.

The refund is made using the same payment method used for the purchase, unless expressly agreed otherwise and at no cost to the consumer. ELYSIUM S.R.L. may withhold the refund until the goods have been received or until the consumer has supplied proof of having sent them back, whichever is earlier (Art. 56(3) Consumer Code).

14. Statutory guarantee of conformity

All products are covered by the statutory guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code. The seller is liable for any lack of conformity that becomes apparent within two years of delivery of new goods. The consumer must report the defect within two months of discovering it. Any lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless proven otherwise.

The consumer is entitled, at their choice and free of charge, to repair or replacement of the goods, unless the chosen remedy is impossible or disproportionately costly. Where provided by law, the consumer is entitled to a price reduction or to terminate the contract. The statutory guarantee is in addition to, and does not replace, the consumer's other rights.

15. Liability

ELYSIUM S.R.L. is liable for the correct performance of the contract in accordance with the law. These terms do not exclude or limit the seller's liability where the law does not allow it, nor the consumer's mandatory rights. The seller is not liable for delays or non-performance caused by force majeure, of which it will inform the customer promptly.

16. Complaints and customer service

For assistance, order information, returns and complaints, customers can write to info@amalfinewservice.it or to the PEC elysiumamalfi@pec.it, quoting the order number. ELYSIUM S.R.L. normally replies within 10 business days.

17. Privacy

Customers' personal data are processed to manage orders, delivery, payments, returns and tax obligations, as described in the AMALFI VIBES Privacy Policy. The use of cookies and similar tools is described in the Cookie Policy.

18. Governing law and disputes

The contract is governed by Italian law. Consumers resident in another European Union country continue to benefit from the mandatory consumer-protection rules of their country of residence (Art. 6 Regulation (EC) 593/2008).

Disputes with consumers fall under the jurisdiction of the court of the consumer's place of residence or domicile (Art. 66-bis Consumer Code). Consumers may also use the out-of-court dispute resolution procedures provided for in Articles 141 et seq. of the Consumer Code and, for cross-border disputes, the European Consumer Centres Network (ECC-Net).

19. Changes

ELYSIUM S.R.L. may update these terms by publishing the new version on this page with its date and version number. Each order is governed by the terms in force when it is sent: later changes do not apply to contracts already concluded.
